Stacy was on her way home from work via her usual route. It was 11:00 pm. When she entered the intersection on a green light, she was broad-sided by a car full of teenagers. Her car was totaled.
While she was being interviewed by the police, she was told that the other driver claimed he had entered the intersection on a green light. There were no witnesses to corroborate Stacy’s version of the accident. Of course, all the kids in the other car supported their friend’s - the driver’s - side of the story.
When Stacy came to MW Injury Resolutions she had already been turned away by several attorneys. Our name had been given to her by an insurance defense attorney from the firm on the other side. He thought they were worthy adversaries, but explained to Stacy that a "red light/green light" dispute was a difficult case and it was unlikely she would be able to win.
Stacy would not accept that explanation; after all, she knew she had the green light. She traveled this same street every night at the same time, returning from work, and just knew she was right.
Jean Magladry was very attentive during her meeting with Stacy. She said, "Let’s call the city and see what the timing on the lights is at that time of night." It turned out that the lights were, in fact, timed. The light for Stacy stayed green all the time at night unless another car was stopped at the intersection and had tripped the light to change from red to green. In other words, the car full of kids had to have stopped completely at the intersection for their claim to be true.
Jean took the other driver’s deposition. She had only one question: "Did you stop at the intersection?" "No," the young man replied, "I had the green light."
The insurance company wrote the settlement check that very day.
